Grooveday terms of use
This is a translation. The Polish version is binding.
§ 1. Who provides the service
- These terms set out the rules for using the Grooveday app for Android (Google Play:
app.grooveday). They are the terms for providing services by electronic means (Article 8 of the Polish Act on Providing Services by Electronic Means). - The service provider is SOLUTIONS 4IT ŁUKASZ ŻOCHOWSKI, ul. Księdza Biskupa Władysława Bandurskiego 50b, 05-270 Marki, Poland, NIP (Polish tax ID) 1251267244, entered in CEIDG (the Polish business register); email: [email protected] (“we”, “us”).
- These terms are available free of charge in the app (also offline) and at grooveday.app/en/terms/. You can save and print them.
- These terms don’t limit the rights you have under consumer protection law. We also apply these rules to a sole trader if the contract isn’t of a professional nature for them.
§ 2. What Grooveday offers
- Grooveday is for tracking habits and supporting you as you build them.
- Free version, with no time limit: up to 5 active habits (the archive doesn’t count), checking off, reminders, a streak with a rest day, check-in history, Learn (105 educational articles), backups, import and export (JSON, CSV).
- Grooveday Plus (a paid subscription) adds, among other things, unlimited habits, points and stages, the weekly summary, the year map, Mini version, the backup plan, “Not today”, “What got in the way?”, habits with an amount or a limit, “When? Right after what?” and the widget. The full list is in the app, on the Plus screen.
- The app has no account, no ads and no analytics, and it doesn’t connect to the internet.
§ 3. Technical requirements
- A device with Android 7.0 or later and free storage space.
- To download the app and buy Plus, you need the Google Play app, a Google account and an internet connection. Grooveday itself works without the internet.
- Reminders need permission to send notifications. You save backups in a place you choose.
§ 4. Contract for using the app
- The contract is concluded when you install the app and start using it. It is free of charge and concluded for an indefinite period.
- You can end it at any time, without giving a reason, by uninstalling the app. Your data will disappear from the phone; only the backups you saved outside the app will remain.
- We may stop providing the service for a valid reason (a change in the law or in Google Play requirements, or the end of our business). We’ll let you know in the app or at grooveday.app at least 30 days in advance. If you have a paid Plus period, we’ll give you access until it ends or a refund of the unused part of the price through Google Play.
- The app is for people aged 16 and over. A minor may buy Plus with the consent of a parent or guardian.
§ 5. Grooveday Plus
- Plus costs PLN 19.99 a month or PLN 99.99 a year (VAT included). The price shown on the purchase screen in Google Play is binding; in other countries, it may be shown in a different currency.
- The subscription is sold and billed by Google Play; in the European Economic Area, the seller is Google. Payments, purchase confirmations, refunds and withdrawal from the contract are handled by Google under the Google Play Terms of Service and the Google Play refund policies. We don’t receive your card details.
- The subscription renews automatically every month or every year until you cancel it. You cancel it in Google Play: Profile → Payments & subscriptions → Subscriptions → Grooveday → Cancel. Uninstalling the app doesn’t cancel the subscription.
- After you cancel, Plus works until the end of the period you’ve paid for.
- Google will notify you of a price change before it takes effect, under the Google Play rules. You can then cancel the subscription.
- On a new phone, use the “Restore purchases” button and the same Google account.
§ 6. Free trial
- In the app, you can try the full version with Plus free of charge. You don’t enter a card, and there’s no automatic payment. The free trial ends on its own and doesn’t turn into a subscription.
- The free trial starts when you add your first habit. It lasts 30 days if you add it on or before January 31, 2027, and 21 days if you add it later. We show the end date in the app.
- The free trial is available once per installation. Its date is saved in the backup, so importing a backup doesn’t give you a new free trial.
§ 7. When Plus or the free trial ends
- Nothing disappears. Your habits, history and entries from Plus features stay. You can view Plus features, but you need Plus to use them again. Habits that are active above the limit stay active; you can add a new one when you have fewer than 5 active habits.
- The app checks the subscription through Google Play on your phone. If it can’t confirm it (for example, when the phone is offline), Plus keeps working for 7 days from the last confirmation. After that, Plus features are view-only until Google Play confirms the subscription again. No data is lost.
§ 8. Data and security
- Your data is only on your phone, in an encrypted database. We have no access to it and can’t recover it. Details: Privacy policy.
- Risks worth knowing about:
- backup and export files aren’t encrypted: anyone with access to them can see your habits;
- uninstalling the app, “Clear storage”, or losing or damaging your phone deletes the data permanently, so make backups;
- habit names may be visible in notifications and on the widget;
- anyone who has your unlocked phone can open the app, so use a screen lock;
- download the app only from Google Play.
§ 9. Health
- Grooveday is not a medical device, doesn’t make diagnoses and doesn’t replace advice from a doctor, psychologist, dietitian or other specialist.
- The articles in Learn are general and educational. Before you significantly change how much you move, sleep, eat or drink, talk to a specialist, especially if you’re pregnant, ill or taking medication.
- If someone’s health or life is in danger, call 112 (the emergency number in the EU) or your local emergency number.
§ 10. Rules of use and copyright
- We grant you a non-exclusive, non-transferable license to use the app on your devices, for personal use, for the term of the contract. You may not sell, distribute or modify it, except for actions permitted by law (including Article 75 of the Polish Copyright and Related Rights Act).
- Don’t enter unlawful content into the app.
- The app, its design, the Grooveday name and the articles in Learn are protected by law. The articles are our own work, based on the sources listed with each of them. You may read them and quote them within the limits of the right to quote, giving the source. Any other distribution requires our consent.
- Book titles, method names and trademarks mentioned in Learn belong to their owners and are used only to identify the source. Grooveday isn’t affiliated with or endorsed by them.
§ 11. Updates and changes to the app
- Through Google Play, we provide updates, including security updates, needed to keep the app in conformity with the contract. If you don’t install, within a reasonable time, an update that we’ve told you about, together with the consequences of not installing it, we aren’t liable for a lack of conformity resulting solely from that.
- We may change the app for justified reasons (fixes, new features, requirements of the law or of Google Play), at no extra cost to you. If a change significantly affects your access to Plus or your use of it for the worse, we’ll let you know in advance in the app. You may then terminate the contract within 30 days, under the Polish Consumer Rights Act.
§ 12. Complaints
- Send a complaint about how the app works, including Plus features, to [email protected]. Describe the problem and give the app version and your phone model. If the complaint concerns Plus, add the order number from the Google confirmation (it starts with “GPA.”).
- We’ll reply within 14 days. If we don’t reply within this time, it means we’ve accepted the complaint.
- Complaints about payments, charges and refunds are made in Google Play.
- This procedure doesn’t limit your statutory rights, for example in the case of a lack of conformity of digital content or a digital service with the contract.
§ 13. Out-of-court dispute resolution
- The EU ODR platform was closed on July 20, 2025 (Regulation (EU) 2024/3228).
- Free help is available from a municipal or district consumer ombudsman and from the provincial Trade Inspection office (mediation, permanent consumer arbitration court). In disputes with a business from another EU country, the European Consumer Centre can help (konsument.gov.pl). The register of these bodies is kept by the President of UOKiK, the Polish Office of Competition and Consumer Protection (uokik.gov.pl).
- Out-of-court proceedings are voluntary for both parties. We’ll decide on taking part in our reply to the complaint.
§ 14. Changes to these terms
- We may change these terms for a valid reason: a change in the law, in Google Play requirements, a decision of an authority, a change in the app’s features, in the scope or prices of the services, or security reasons.
- We’ll let you know about a change in the app and at grooveday.app at least 14 days before it takes effect. A change doesn’t affect rights acquired earlier.
- If you don’t accept the changes, you can end the contract before they take effect: uninstall the app and cancel the subscription in Google Play.
§ 15. Final provisions
- The contract is governed by Polish law. If you’re a consumer, you keep the protection of the mandatory provisions of the law of the country where you usually live.
- A consumer may bring a case before the court that has jurisdiction under the general rules, including in their country of residence.
- These terms are available in Polish. Versions in other languages are supporting translations; the Polish version is binding.
